Deering’s DCFS Bill Clears Both Chambers, Awaits Further Action

SPRINGFIELD, IL… State Representative Regan Deering (R-Decatur) passed legislation out of both Chambers that works to improve transparency in child abuse and neglect investigations that are conducted by the Illinois Department of Children and Family Services (DCFS).

HB 4242 requires DCFS to include written notification to an alleged perpetrator in an investigation, regardless of whether an administration appeal has been requested. The bill specifically outlines six items that must be included in the written notification:

  • A statement of allegation and the indicated finding
  • The length of time the indicated finding will be maintained in the State Central Register
  • A notice of the right to request an administrative appeal of the finding
  • The period of time for when an administrative appeal must be requested
  • How to request an administrative appeal
  • A notice of the request for a copy of the investigative file and how to request it, regardless of whether an administrative appeal was requested

“This bill was filed to help families in the event of a DCFS investigation,” said Rep. Deering. “It is imperative that DCFS provides clarity and support to families going through the process, but it also remains equally important that workable policies remain codified in law for our agencies to follow.”

The bill was carried in the Senate by State Senator Darby Hills (R-Barrington Hills).

It is our duty to ensure integrity is upheld in state government and this bill does just that whilst supporting our state agency charged with handling these investigations,” concluded Deering.
